Presentation of the National Travel Data Agency (ANDV)

The National Travel Data Agency (ANDV) was created on the 1st July 2022 by Decree n°2022-752 of the 29th April 2022. It is an interministerial service, nationally competent, attached to the Ministry of the Interior. It is under the authority of the General Director of the French national police (DGPN). Its orientation committee is led by the Secretary General for Defence and National Security (SGDSN).

The ANDV carries out its missions for the Ministry of the Economy, Finance and Industrial and Digital Sovereignty, the Ministry of Armed forces and the Ministry of the Interior and Overseas, with the support of the Secretary of State in charge of the Sea and the Ministry of Ecological Transition and Territorial Cohesion.

The ANDV is in charge of the implementation and the improvement of collection and exploitation systems for travel data (reservation, check-in and boarding data of passengers) for air, maritime, rail and road transport, departing from France or arriving in France. The agency is also responsible for the collection of the data, the control of its quality and reliability, and it assumes the function of Passengers Information Unit (PIU), as provided for in the European directive 2016/681.

The ANDV contributes to the prevention, detection, investigation and prosecution of terrorist offences, serious crimes and attacks on the fundamental interests of the Nation, as well as border control, the fight against irregular immigration and transport security.

Presentation of the “API-PNR France system”

Created in 2014, the API-PNR system covers all air carriers and all passengers from flights coming or leaving French territory.

The French API-PNR system allows the automatic processing of reservation data (PNR) and check-in and boarding data (API) collected by air carriers. This system aims to prevent, detect and prosecute more efficiently terrorist offences and serious crime, as well as violations to the Nation’s fundamental interests, under the conditions and terms fixed by the national and the European regulation.

Reservation data are initially transmitted by air carriers and travel agencies 48 hours prior to the flight’s departure, and a second time immediately after the closing of the flight. Check-in and boarding data are transmitted by the air carriers at the closing of the gates.

Competent authorities entitled to use the API-PNR system are the Direction Générale de la Police nationale, the Direction Générale de la Gendarmerie Nationale, the Direction Générale de la Sécurité Extérieure, the Direction Générale de la Sécurité Intérieure, the Direction Générale des Douanes et des Droits Indirects, the Direction du Renseignement Militaire, the Direction du Renseignement et de la Sécurité de la Défense, and the Direction Nationale du Renseignement et des Enquêtes Douanières.

Regulation on API-PNR France

The API-PNR system is based on legal texts that are both national and European. They constitute the legal basis of API-PNR data processing, including:

Of the European Parliament and of the Council of 27 April 2016 on the use of passenger name record (PNR) data for the prevention, detection, investigation and prosecution of terrorist offences and serious crime.

This directive provides for the framework for the transfer of PNR data by air carriers as well as the processing of such data. It also provides for the purposes of the processing, namely the prevention and the detection of terrorist offences and serious crime, as well as the investigation and prosecution of such actions.

European States have the obligation to transpose the provisions of this directive into their national law. France has therefore transcribed these elements into its national texts, mainly into the Internal Security Code.

This decree modifies the automatic processing of personal data called “API-PNR France”. It modifies the purposes of the processing, the duration of conservation of the recorded data, the categories of people having access to this data, the categories of people that may receive this data, the terms of data exchange and transfer as well as the procedures for exercising rights of access and rectification of the data. It completes the procedures of traceability of the “API-PNR France system”.

This article states that the concerned people have the right to know whether their personal data have been subject to a particular processing or not. In such a case, the legal provisions specify the conditions of access and processing.

This article states the terms under which the automated processing of personal data must be carried out in the context of the prevention and detection of specific infractions. Besides, it provides for the duration of data retention, as well as the information duty of the air carriers to inform the passengers about the personal data processing.

This article provides that the exercise of the right of access, rectification and erasure of data is exercised by contacting the director of the ANDV or his deputy. However, they may refuse under the terms defined in the same article.
